Claim refund or compensation

Montreal Convention

The Montreal Convention is an international agreement from 1999 that regulates airlines’ liability for international air travel. It is particularly relevant if your luggage is delayed, damaged or lost, but also covers personal injury and certain losses arising as a result of a delayed flight. The Convention has been incorporated into UK law and applies in parallel with EU Regulation 261/2004.

  • Significance: Rules on airlines’ liability for damages in connection with international air travel

  • Relevant to: Baggage issues, personal injury and costs arising from flight delays

  • Regulation: The Montreal Convention (1999); supplements EU Regulation 261/2004

What does this mean for your flight?

If your luggage is delayed, damaged or lost, you may be entitled to claim compensation from the airline. In the event of a flight delay, the Convention may also apply to costs that you can prove were caused by the delay. This differs from the standardised compensation you may be entitled to in certain cases under EU Regulation 261/2004.

Example: Your checked-in bag arrives damaged. You report the damage to the airline and keep documentation so that you can claim compensation. The claim for damage to your luggage is assessed according to the rules on the airline’s liability for luggage, not under EU Regulation 261.

Has your luggage been delayed, lost or damaged?

You may be entitled to reimbursement of necessary expenses. Find out what applies and how to claim compensation.
